Consumers have a general trust that the products on the market are safe. Unfortunately, products are not always as heavily regulated as you would expect, and oftentimes products are regulated but they’re manufactured or designed poorly—producing unsafe products. Generally, there are three types of product liability cases. Manufacturing defects can occur when the manufacturer deviates from the product they are intending on producing. This can result in defective products that are unsafe because of a mistake made during the manufacturing product. Design defects can occur where a manufacturer poorly designs a product causing it to be unsafe. Where a manufacturer fails to provide adequate warnings or instructions concerning the proper use of the product, and injuries result that are directly caused by the manufacturer’s failure to warn, a user may have a failure to warn claim against the manufacturer.
